DEFINITIONS
1. The definitions used in the Terms and Conditions shall have the following meanings:
• Business day – one day from Monday to Friday, excluding public holidays.
• Buyer – a natural person with full legal capacity, and in cases provided for by the relevant regulations, also a natural person with limited legal capacity or a legal person or an organizational unit without legal personality, which is granted legal capacity by the relevant Act, which has concluded or intends to conclude a Sales Agreement with the Seller.
• Civil Code – the Civil Code Act of 23 April 1964 (Journal of Laws of 1964, No. 16, item 93, as amended).
• Consumer - according to Article 22[1] of the Civil Code - a natural person who enters into a legal transaction with an entrepreneur, that is not directly related to his or her business or professional activity.
• Newsletter – a free service offered by the Seller, consisting in sending commercial offers, information about promotions and events via e-mail. The newsletter is sent to those Buyers who have agreed to receive it.
• Order – a declaration of intent made by the Buyer via the Order Form in order to conclude a Sales Agreement for the sale of the Products indicated in the order. An Order is considered to have been placed after it has been confirmed for execution in the return information from the Seller.
• Order Form – a form on the Store's website that allows to make a purchase in the Store.
• Privacy Policy – regulations adopted and implemented by the Seller regarding the processing and protection of personal data.
• Product – an item available in the Online Store, which can be purchased by the Buyer after submitting a request for proposal.
• Sales Agreements - an agreement for the sale of Products within the meaning of the Civil Code, concluded between the Seller and the Buyer, using the Store's Website
• Seller - the owner of the Online Store, available at firstroundpop.pl - Eurotac sp zoo, with its registered office in Warsaw at Kajki 41/43 lok.10, postal code 04-634, NIP: 9522236628, REGON: 524227488 entered into the National Court Register kept by the District Court for the capital city of Warsaw in Warsaw, XIV Commercial Division of the National Court Register under KRS number: 0001014325 hereinafter also referred to as "Eurotac".
• User – a natural person with full legal capacity, and in cases provided for by the relevant regulations, also a natural person with limited legal capacity or a legal person or an organizational unit without legal personality, which visits the Store and uses the services offered on its website.
• Store (Store 's Website) – a website enabling Buyers to get acquainted with the products offered by the Seller, as well as to conclude the Sales Agreement.
• Terms and Conditions – these Terms and Conditions.
GENERAL
1. Eurotac is the administrator of personal data processed in connection with the implementation of the provisions of these Terms and Conditions. Personal data is processed for the purposes, to the extent and based on the principles indicated in the privacy policy available on the Store's websites. Providing personal data is voluntary. Every person whose personal data is processed by Eurotac has the right to inspect their content and the right to update and correct them.
2. These Terms and Conditions are the regulations referred to in Article 8 of the Act on the provision of electronic services.
3. Buyers can access these Terms and Conditions at any time via the link on the homepage of firstroundpop.pl, download and print them.
4. The Seller provides account services, placing and fulfilling orders in the Store, runs a blog and sends a newsletter. Account registration is done by filling in and accepting the registration form and terms and conditions available on one of the Store's websites.
5. The presented products and prices do not constitute a commercial offer within the meaning of the Civil Code, but only an invitation to submit offers/orders pursuant to Article 71 of the Civil Code.
6. Products sold through the Store are brand new and covered by the manufacturer's warranty.
7. The store sells only within the Schengen Area.
8. All prices quoted by the Seller include VAT, are expressed in Polish currency (PLN), EUR and British pound and do not include delivery costs.
9. The final cost of the order consists of the price of the product and the cost of shipping, depending on the forms of payment and delivery chosen by the customer.
10. With respect to the Buyer 's Order, the prices given on the Store's website at the time of placing the Order are binding. The prices at which the Order is placed do not change regardless of the price changes in the Store that may occur after the Buyer places the Order.
11. Orders are accepted:
• via the Store's website using the Order Form (Store firstroundpop.pl)
• via e-mail to the following address: info@firstroundpop.pl
12. In the case of an Order with shipping outside of Poland, it is the responsibility of the Buyer to possess and use the Products purchased in the Store in accordance with local laws. The Store does not take responsibility for Buyers not complying with local laws and regulations.
13. The Seller reserves the right not to accept orders that raise doubts, of which the Buyer will be immediately informed.
14. The Seller makes every effort to ensure that the Store's offer is consistent with the current stock levels. In the event of unavailability of all or part of the products covered by the Order, the Buyer shall be informed about it after placing the Order.
15. If the ordered product is not in stock, the Buyer has the right to:
• change the product to another one, the price of which does not exceed the price of the ordered product and return the difference in prices to the bank account indicated by the Buyer, or
• prolonged waiting for the full execution of the order, or
• cancel the order in its entirety. The amount paid is then returned to the Buyer to the indicated bank account.
16. In matters not covered by the Regulations, the following provisions shall apply:
• The Act on the Provision of Electronic Services of 18 July 2002 (Journal of Laws No. 144, item 1204, as amended),
• Consumer Rights Act of 30 May 2014 (Journal of Laws of 2014, item 827),
• Act on Out-of-Court Resolution of Consumer Disputes of 23 September 2016 (Laws of 2016, item 1823),
• the Act on Weapons and Ammunition of 21 May 1999 (Journal of Laws of 2012, item 576, as amended),
• The Civil Code Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended) and other relevant provisions of Polish law.
PLACING AND FULFILLING ORDERS
17. Orders can be placed in the Store via the Store's Website or by email info@firstroundpop.pl 7 days a week, 24 hours a day.
18. The Sales Agreement between the Buyer and the Seller is concluded by placing an Order by the Buyer using the Order Form in the Online Store or by sending an order to the e-mail address info@firstroundpop.pl and paying for it according to the point 20 of the Terms and Conditions.
19. The Seller sends the Buyer an e-mail message to the e-mail address provided in the Order, containing a confirmation of receiving of the Order, confirmation of receiving the payment for the ordered products and acceptance of the Order for execution.
PAYMENTS AND DELIVERY TIMES
20. Payment for the ordered products can be made through:
• bank transfer to the Seller's bank account.
• by debit/credit card (Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro) via Stripe - the external payment system, operated by Stripe, Inc. based in San Francisco, USA
21. The Seller delivers Products within the Schengen Area to the address indicated in the Order form.
22. The cost of delivery of the goods is covered by the Buyer.
23. Immediately after the shipment is sent by the Seller, the Seller informs the Buyer about it in a message sent to the Seller's e-mail address.
24. The Seller publishes on the Website of the Store information about the number of Business Days needed for delivery, depending on the choice of delivery method and the country to which the shipment is made.
25. The buyer has the right to inspect the delivered shipment at the time and in the usual manner for shipments of a given type. In the event of non-compliance of the contents of the shipment with the Order or its damage, the Buyer has the right to demand that the supplier's employee write down an appropriate protocol. A written protocol is the basis for a complaint.
26. The benefits, obligations, risks of damage or loss associated with the possession of the ordered Product pass to the Buyer upon delivery by the supplier. If, at the request of the Buyer, the delivery of the ordered Product was made by a carrier other than the one indicated in the delivery options in the Store, the delivery of the item by the Seller to the carrier shall be deemed to be the delivery of the item to the Buyer.
27. The Seller attaches a receipt or VAT invoice covering the delivered Products to the shipment.
RIGHT OF WITHDRAWAL & RETURNS
28. A Buyer who is a Consumer who has purchased products in the Store may, without giving reasons, withdraw from the Sales Agreement within 14 days from the date on which he came into possession of the Product, by sending a statement of withdrawal from the Sales Contract to the e-mail address of info@firstroundpop.pl
29. In the event of withdrawal from the Sales Agreement, it shall be deemed not to have been concluded, and the Buyer shall be obliged to return the purchased Products to the Seller or hand them over to a person authorized by the Seller to collect them, no later than 14 days from the date on which the Buyer withdrew from the Contract of Sale. The date of return is the day of sending the parcel by the Buyer.
30. The Buyer sends the returned Product to the following address: Kajki 41/43 flat 10, 04-634 Warsaw. The Buyer attaches the original sales document (VAT invoice) to the returned Product.
31. The costs of returning the Product to the Seller shall be borne by the Buyer withdrawing from the Contract of Sale.
32. The Seller shall refund the price of the Product by bank transfer to the account from which the Order was paid (unless the Buyer has agreed to another method of refunding the price of the Order) within 14 days from the date of returning the Product to the Seller. The date of return is the date of receipt of the shipment by the Seller.
33. The Buyer shall be liable for damages towards the Seller, pursuant to Article 34 § 4 of the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended)
COMPLAINTS
34. All Products offered in the Store have a manufacturer's warranty valid in the Republic of Poland. Manufacturer’s warranty does not exclude the Buyer's warranty rights under the Civil Code.
35. The Seller's liability towards the Buyer for physical or legal defects under the warranty is defined by generally applicable laws, in particular in Articles 556-576 of the Civil Code.
36. Complaints should be submitted:
• to the e-mail address: info@firstroundpop.pl,
• in writing to the address of Eurotac: Kajki 41/43 m.10, 04-634 Warsaw, Poland.
37. In the complaint, it is recommended to provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of the defect, the preferred method of bringing the Product into compliance with the Sales Agreement or a request for a price reduction or a statement of withdrawal from the Sales Agreement and contact details. The information provided will facilitate and accelerate the consideration of the complaint by the Seller.
38. The basis for accepting a complaint is the proof of purchase of goods (VAT invoice)
39. The Seller shall respond to the complaint using the fastest means of communication provided by the Buyer, immediately, no later than within 14 days from the date of its submission.
40. Failure of the Seller to respond to the request of the Buyer who is a Consumer for the replacement of the Product, removal of a defect in the Product or reduction of the price of the Product within 14 days of its receipt means that the Seller considers this request to be justified.
41. After the Buyer receives information from the Seller about the acceptance of the complaint, the Product should be sent to the following address: Eurotac sp zoo, Kajki 41/43 m.10, 04-634 Warsaw. If the Buyer is a Consumer, the cost of delivery of the Product is borne by the Seller, in the case of a Buyer who is not a consumer, the cost of delivery is borne by the Buyer.
